Актуальные проблемы истории развития саморегулирования в России
Аннотация
Рассмотрены различные позиции ученых-правоведов по вопросу истории саморегулирования в России. Выявлены и проанализированы дискуссионные моменты, которые заключаются в изучении истории российского саморегулирования через призму современной модели саморегулирования, без учета контекста времени исторического периода, без разделения саморегулирования на социальное, экономическое и правовое явление, с установлением равенства между саморегулированием и саморегулируемыми организациями. В частности, на примере Иванской общины и иных артелей купцов XII–XV вв. продемонстрировано, что описанный выше подход приводит к спорной квалификации организаций в качестве прообразов современных саморегулируемых организаций, различному пониманию правовой природы и сущности саморегулирования и, как следствие, противоречивым заключениям об истории саморегулирования в России.
