Подводные камни пенсионного законодательства
Аннотация
Больше 11 лет действует очередной «громкий» закон о страховых пенсиях, который кардинально изменил основания и порядок установления страховых пенсий. Акцент граждан и ученых был направлен на рассмотрение вопроса об увеличении пенсионного возраста. Вместе с тем в тени остался без должного внимания совершенно новый слагаемый при определении права на пенсию – индивидуальный пенсионный коэффициент (ИПК). Именно невыполнение этого условия не позволит гражданину получать страховую пенсию при наличии требуемого стажа и достижения пенсионного возраста. В статье рассматривается отдельный случай очевидного пробела пенсионного законодательства, при котором трансформация накопительного элемента пенсионного законодательства привела к тому, что учет ИПК идет только за счет уплаты страховых взносов на страховую пенсию без учета страховых взносов на накопительную пенсию, что не соответствует социальной справедливости и приводит к ущемлению пенсионных прав граждан.
