Адаптация экспериментального правового регулирования для достижения национальных целей развития Российской Федерации

Аннотация
Проведен анализ текущей ситуации с изменением нормативного правового регулирования и его инструментов, в том числе экспериментальных правовых режимов, под воздействием развития технологий. Обосновано, что в основе адаптации правового регулирования к технологическим и геополитическим вызовам должен быть антропоцентричный консервативный подход, а само целеполагание в сфере технологического развития, в том числе цифровых технологий и цифровой трансформации, должно быть основано на традиционных правовых ценностях. Разработаны элементы публично-правового механизма обеспечения достижения национальных целей развития России, включая согласование целей нормотворческих планов, целей иных нормативных правовых актов, а также ориентации на оценку достижения национальных целей традиционных процедур мониторинга правоприменения и оценки фактического воздействия. На основе данных элементов сформулирован комплекс предложений по совершенствованию действующего правового регулирования и практики применения экспериментальных правовых режимов для обеспечения достижения национальных целей развития России.
