Аннотация

Исследуются актуальные вопросы, связанные с квалифицирующими признаками побега. Анализируются квалифицированные составы преступлений, предусмотренных ч. 2, 3 ст. 313 УК РФ. Рассматривается, в каких случаях совершение побега группой лиц по предварительному сговору или организованной группой и (или) с применением насилия, опасного для жизни или здоровья, либо с угрозой применения такого насилия, с применением оружия или предметов, используемых в качестве оружия, охватывается квалификацией по ч. 2 и 3 ст. 313 УК РФ, а в каких случаях требуется дополнительная квалификация по соответствующей статье Особенной части УК РФ по правилам о совокупности преступлений. Изучаются вопросы квалификации действий соучастников побега, а также вопрос о том, может ли в состав организованной группы (ч. 2 ст. 313 УК РФ) входить лицо, не обладающее признаками специального субъекта.
