Право человека на память: к постановке проблемы

Впервые в отечественной юридической науке осуществляется концептуальная постановка проблемы права человека на память. Автор обосновывает правомерность рассмотрения памяти как особого блага, требующего юридического признания и защиты. Исследуется диалектическая связь между правом на память и обязанностью помнить. Особое внимание уделяется анализу конституционных основ права на память в Российской Федерации, в частности значения ст. 67.1 Конституции Российской Федерации. Делается вывод о синтетическом, межпоколенческом характере права на память, обеспечение которого является императивом для современного правового государства.
