Понятие, особенности и формы стимулов и ограничений в отдельных отраслях публичного права

Аннотация

Анализируются особенности закрепления правовых стимулов и правовых ограничений в отдельных отраслях публичного права – в конституционном и административном праве, муниципальном праве. В этих целях были проанализированы труды известных ученых, которые исследовали особенности проявления метода правового регулирования в указанных отраслях права на предмет закрепления правовых стимулов и ограничений. Вдобавок к этому автором были выявлены особенности форм проявления правовых стимулов и ограничений в отдельных публичных отраслях права, а также их взаимообусловленность. Соответственно, данные научные концепции позволили автору сформировать общие выводы о сущности и формах правовых стимулов и ограничений в публичном праве, характерные для их закрепления и в бюджетном праве.
