Убийство при отягчающих обстоятельствах, характеризующих способ действия: проблемные аспекты квалификации и отграничения от смежных составов преступлений (пункты «е» и «ж» части 2 статьи 105 Уголовного кодекса Российской Федерации)

Рассматриваются ключевые проблемы квалификации убийства при отягчающих обстоятельствах, характеризующих способ действия: общеопасный способ (п. «е» ч. 2 ст. 105 УК РФ) и групповые способы (п. «ж» ч. 2 ст. 105 УК РФ). На материале разъяснений Пленума Верховного Суда РФ и судебных актов Верховного Суда РФ анализируются критерии «общеопасности» и «совместности» действий, типовые ошибки следственной и судебной практики, а также конкуренция норм и вопросы совокупности. Обосновывается позиция о необходимости строгого разграничения: 1) общеопасного способа и множественности потерпевших; 2) соисполнительства и пособничества при «групповом» убийстве; 3) квалифицирующих признаков «способа» и иных признаков ч. 2 ст. 105 УК РФ. Формулируются практико-ориентированные рекомендации для правоприменения.
