Trends in the development of modern lex sportiva on the example of anti-doping rules in Russia

Abstract

On the example of the World Anti-Doping Code (WADA Code) in the 2021 edition, the legal nature of lexsportiva would be analyzed, the author's definition of this concept is proposed, an analysis with similar content concept "lexmercatoria" is carried out, trends are planned of the role of lexsportiva in sports activities of Russia and in the world as a whole. Lex sportiva assumes the following distinctive features: firstly, these rules operate on the basis of approval by the professional sports community, as lex mercatoria rules, and secondly, the rules are created by the sports movement itself, and not imposed from above. The author notes that the more the sports industry becomes more independent of state financing, the more it will strive for self-regulation both in the sphere of establishing rules of competitions, building relations with sponsors, and in terms of resolution of sports disputes and conflicts.
