The importance of classification of needless crimes in the category of serious crimes in the solution of preventive challenges of criminal law

Abstract

The relevance of this scientific article is due to the existence of different points of view regarding the advisability of classifying reckless crimes as serious. The repeated change in the approach to the differentiation of crimes by category is largely due to the tendencies of toughening (mitigating) punishment for acts related to violation of traffic rules and the operation of vehicles. Editing of articles 15, 263, 264 is socially conditioned. Taking into account the level of alcoholization and drug addiction of the population, the legislator emphasizes the special social danger of some careless acts. The tougher punishment for their commission will contribute to a change in the legal consciousness of the population. The amendments made by the Federal Law of the Russian Federation of June 17, 2019 No. 146-FZ to the criminal law of the Russian Federation will contribute to the implementation of the tasks specified in the Road Safety Strategy in the Russian Federation for 2018-2024. However, it takes time to change the legal consciousness of the population. In addition, other measures should be applied in parallel to prevent alcoholization and drug addiction of the population. In this regard, the feasibility of changing the categorization of crimes can be confirmed in a few years, and not in the near future.
