The formation of public law in the countries of the continental legal family

Within the framework of this article, debatable issues about the concept and nature of public law are considered. The author explores the process of the origin of the system of public law in the countries of the continental legal family. Simultaneously with the analysis of the history of public law, the author touches on the historical features of the formation and development of continental law as one of the main legal systems of our time. The article highlights three main periods of formation and development of the continental law. The formation of public law, the identification of the nature and essence of public law, the concept and subject of public law are traditionally considered in Western jurisprudence in connection with the doctrine of the division of law into private and public. The article raises controversial issues of the idea of the dichotomy of continental law. The author formulates the concept and subject of public law according to the continental legal doctrine. In conclusion, the author concludes about the increasing role of modern states in stabilizing social processes.
