Conservatism of the legal policy as a guarantee of progress in the sphere of administrative and other public legal relations

Abstract

Some aspects of the impact of administrative legal policy on the formation and change of Russian administrative (substantive and procedural) law are considered. The author's narrative focuses on a conservative approach to the development of the sphere of administrative and other public legal relations, based on the traditional principles of both the rule of law and lawful state, and taking into account national historical, social, legal, state standards and ideas about the purpose of state power, public administration, civil service, proper public administration, effective judicial protection. The purpose of the legal policy is to create and ensure the progressive development of administrative legislation, that determines the design and implementation in legal practice of regulatory legal mechanisms and procedures that guarantee the proper legal parameters of public administration and effective judicial protection in the field of public order. Some legal terms and institutions used in practice that are not able to fully establish the harmonious and full implementation of the mechanism of legal relations outside the context of national legal regulation are subjected to critical reflection. Administrative law as a science globally explores strategic approaches and operational procedures for changing general administrative legislation based on updated priorities for the development of the executive branch, the administrative system, the interaction of public authorities with citizens and organizations, the introduction of useful digitalization technologies and artificial intelligence in the mode of implementing legal relations in the public sphere.
