Abstract

Despite its mental and legal signifi cance (in terms of consequences), such circumstances as the commission by one adult family member (usually a parent) of violent acts (beatings) against another adult family member in the presence of a minor, as well as the infl iction of beatings to a minor, have not received due legal and scientifi c evaluation. A study of some US acts has shown that violent acts in the family committed by one adult family member (partner) against another adult family member in the presence of a minor are both a sign of child abuse and an aggravating circumstance. It is proposed to take into account the circumstances under consideration as aggravating when committing such an administrative offense as beatings (Article 6.1.1 of the Administrative Code of the Russian Federation) and, in this regard, to provide for the qualifi ed composition of this administrative offense.
