Movement towards a human rights model of disability: a general view of the experience and potential of the subjects of the Russian Federation

The article is devoted to the general issues of the implementation of the powers of the state authorities of the subjects of the Russian Federation in the field of social protection of the disabled. The author considers the main results of the analysis of regulatory legal acts of the regional level and the practice of their application. The most significant problems of social protection of disabled people in the context of legal regulation in the subjects of the Russian Federation are classified by content into problems of rulemaking and problems of implementation. The first group includes errors in the formation of the model of separation of powers between the Russian Federation and the subjects of the Russian Federation, entailing unsystematic legal regulation, terminological disorder and lack of documents. The second problem is expressed in the budget and tax imbalance, provoking uneven socio-economic conditions of the subjects of the Russian Federation and budgetary opportunities. At the same time, the article notes the potential of the subjects of the Russian Federation in the context of the formation of a human rights model of disability, which is only partially realized today and consists in the ability to most accurately identify the territorial features of the living conditions of disabled people and reflect the specifics in regulatory legal acts.
