Abstract

The issues related to the possibility of achieving the goal of criminal punishment in the form of restoring social justice are considered. An attempt is made to interpret such a category as social justice not only from the legal side, but also by analyzing its social and philosophical aspects. The question of the reasons for the lack of restoration of social justice as a goal in the penal enforcement legislation is raised. The possibility of excluding the above-mentioned purpose of punishment from the criminal legislation is investigated. A proposal has been made to include in the criminal legislation a new purpose of punishment – the protection of state interests.
