Abstract

It is article justifies the need to be careful about the objective evidentiary capabilities of the disputing parties when determining the rules for the distribution of the burden of proof. Examples of various categories of civil cases illustrate the problem of information asymmetry, analyze the role of the legal presumption in its solution, assess the admissibility and prospects for using other methods of equalizing the procedural status of persons involved in case, taking into account the legal approaches existing in the civil process doctrine.
