Abstract

The article is devoted to current approaches to understanding the requirements of criminal procedural legislation regulating the procedure for compiling a preliminary list of juror candidates. The author notes the absence of uniform requirements for the structure of the list, the predominance of a tendency towards weakening the formal approach. The examples from practice given in the article allow us to hope that the assessment of the actual violation of the rights and legitimate interests of the parties when considering a criminal case with the participation of jurors will be of decisive importance, eliminating the formal approach when courts consider cases of this category.
