Personal rights in the structure of the legal status of an individual

Abstract

The revival in modern Russia of the idea of the priority of human rights and freedoms has caused increased attention of domestic jurisprudence to issues related to the legal status of the individual. Analyzing the points of view of Russian scientists regarding the structure and content of the legal status of a person, its relationship with the concept of the legal status of a person, the author comes to the conclusion that it is necessary to differentiate these legal categories. The author also examines the main elements of the legal status of a person, defines the criteria for distinguishing the concepts of "personal rights" and "personal rights". A comparative analysis of scientific positions regarding the legal nature of the institute of personal rights and its content is given. Based on the results of the research, the author formulates a list of basic personal rights that are the central element of the legal status of an individual, determines their place in the circle of other human rights and the limits of their implementation.
