Impact of age on citizens' realization of freedom of labor: constitutional and anti-discriminatory legislation of foreign countries

Abstract

On the basis of the analysis of constitutions of foreign countries, labor and special anti-discriminatory legislation of some states of Europe and the USA, judicial practice the peculiarities of application of the principle of prohibition of discrimination in realization by citizens of freedom of labor and the right to work depending on age are revealed. It is concluded that the attitude in legislation and judicial practice to age as a ground of discrimination differs from approaches to other discriminatory grounds. The realities of the modern labor market require changes in approaches to policy in the fi eld of protection of citizens from discrimination on the basis of age, both in foreign countries and in Russia.
