Abstract

It is presents a point of view on the methods of legal regulation of public relations in the field of bankruptcy. It is argues that the current method of legal regulation corresponds to the dominant type of legal understanding. That such a method of regulation – the jurisprudence of concepts or otherwise legal hermeneutics – corresponds to legal positivism and is a «soft» means of legal regulation, which presupposes an effective combination of two oppositely directed rules of law enforcement: «stand by what has been decided and do not disturb the peace» (Stare decisis et non quieta movere – лат.) and «the court knows the law» (Jura novit curia – лат.). The effectiveness of this method is manifested in ensuring the unity of law enforcement and at the same time the necessary dynamics of the development of law. The action of the method of analytical jurisprudence is illustrated by examples of individual normative rules of conduct of subjects of legal relations in the field of bankruptcy, created by many years of but heterogeneous judicial practice and having practical significance for economic turnover.
