Distinguishing criteria between a set-off objection and an set-off counterclaim

The author comes to the conclusion that these procedures for accepting mutual obligations, despite the use of the term "set-off", represent substantially different legal structures. Unlike a counterclaim, which can be used to terminate any possible mutual obligations, the use of an objection for these purposes has two allowability criteria: 1) a substantive criterion, consisting in the possibility of obligation termination in the manner referred to by the defendant; 2) procedural criteria, presupposing the indisputability of the plaintiff's mutual obligation is based.
