Unitary and corporate legal entities: the problem of the criterion of differentiation

Abstract

In the article, the author analyzes the criterion fixed in Article 65.1 of the Civil Code of the Russian Federation for dividing legal entities into corporate and unitary, determines how this criterion is reflected in each organizational and legal form attributed to unitary organizations. The article formulates a consistent approach to understanding the essence of the difference between unitary and corporate legal entities.
