Restriction of citizen’s legal capacity: procedural aspect

Abstract

The article analyzes the theoretical and practical problems related to the specifics of the implementation of the provisions of the Civil Procedure Code related to the limitation of a citizen’s legal capacity. It is noted that there are a number of legislative gaps and inconsistencies between the norms of the Civil Code of the Russian Federation and the Civil Procedure Code of the Russian Federation. Special attention is also paid to the terminological aspect of the topic under consideration, and legislative changes related to the specification of individual terms are proposed.
