Abstract

For more than 11 years, another «notorious» law on insurance pensions has been in effect, which has radically changed the grounds and procedure for establishing insurance pensions. The focus of citizens and scientists was on considering the issue of increasing the retirement age. At the same time, a completely new component in determining the right to a pension – the individual pension coefficient (IPC) – remained in the shadows without due attention. It is the failure to fulfill this condition that will not allow a citizen to receive an insurance pension if he has the required length of service and has reached retirement age. The article considers a separate case of an obvious gap in the pension legislation, in which the transformation of the funded element of the pension legislation has led to the fact that the IPC is taken into account only by paying insurance premiums for an insurance pension without taking into account insurance premiums for a funded pension, which does not correspond to social justice and, accordingly, leads to an infringement of the pension rights of citizens.
