Public-law regulation of using the «Antiplagiat» system at the present stage of development of the russian state and society, or twenty years onward

Abstract

The article is devoted to the analysis of legal and practical uncertainty surrounding the 20- year application of the «Antiplagiat» system in scientific and educational activities. The author identifies the absence of regulatory frameworks governing the system’s use, which leads to arbitrary practices and the formalization of scientific evaluation. It is established that the criteria of «originality» are often interpreted without regard for the genre-specific and disciplinary features of texts, particularly in the humanities, where intertextual work holds independent scholarly value. The article substantiates the inadmissibility of substituting academic judgment with a digital percentage that lacks universal meaning. Technical and procedural flaws of the system are critically examined, including result instability, limited appeal mechanisms, and the opacity of algorithms. The risks of distorting academic competition and infringing upon the rights of bona fi de authors are revealed. The author emphasizes the necessity of creating a legal and ethical framework for the system’s application, incorporating transparent standards, differentiation by types of work, and the development of expert review. Proposals are formulated for the development of regulatory acts with the participation of the Russian Government and the academic community. The article argues for a shift from formal digital control to substantive scientific evaluation. It demonstrates that without a regulatory basis, the use of the «Antiplagiat» system undermines scientific trust, academic freedom, and the principles of a rule-of-law state.
