The unity of the legal space of the Russian Federation: the constitutional and legal essence and some issues of implementation practice

Abstract

Ensuring the stability of the legal space in modern conditions is a necessary condition for the progressive development of state-public relations. Depending on the state of legal regulation of the spheres of life of modern society, not only the development of legal institutions depends, but also the level of legal awareness and legal culture of citizens. This study analyzes the constitutional and legal foundations of the unity of the legal space in their logical interrelation and some aspects of the practice of their implementation. Based on the results of the conducted research, a conclusion is drawn about the multilevel and multifactorial nature of the structural elements that ensure the achievement of the unity of the legal space. Concrete examples reveal the interrelationship of specific institutions (for example, the institute of federal intervention, the unity of judicial law enforcement, legislative planning, law enforcement monitoring, etc.). At the present stage of the development of statehood, any of the developing political and legal processes should be a comprehensive system that includes and simultaneously reflects the totality of ongoing socio-economic and political processes. Only a systematic approach to the organization of state-legal relations can be the key to effective and efficient implementation of the policy. Even those processes, including ensuring the unity of the legal space, which at first glance can be characterized from the point of view of any one aspect, for example, the legal examination of normative acts, represent a complex system of relations. In this regard, in order to understand and predict the further vector of development of the system of political and legal relations, it seems necessary to implement a systematic approach to understanding the developing processes.
