Transport infrastructure and the conceptual framework of the Federal law «On transport security»

The article examines the categorical correlation between the concept of transport infrastructure and the definitions enshrined in Article 1 of Federal Law No. 16-FZ of 9 February 2007 «On Transport Security». The author demonstrates that, notwithstanding the significance of this law as a comprehensive regulatory act that established the basic conceptual framework of the transport sector, its system of legal definitions is primarily oriented toward public-law objectives of ensuring security and does not contain an autonomous definition of infrastructure. As a result, transport infrastructure is effectively reduced exclusively to a list of protected facilities and entities. Based on an analysis of legal doctrine and judicial practice, the study identifies methodological contradictions and law-enforcement deficiencies caused by terminological inconsistency.
