Regulatory framework of the migration law and order in the Russian Federation: areas for improvement

Abstract

The global migration crisis, which is the issues of more detailed study by researchers of the migration processes, requires more attention to the issue of migration legal order in host States. In domestic legal science, legal order refers to the state of regularity of social relations, based on law and legality, expressed in the lawful conduct of the participants in these relations . Thus, migration legal order is a direct result of the implementation of law of governing migration relations. Its content is the lawful conduct of participants in migration legal relations with subjective rights and legal obligations. At the same time, the basis of the migration order is the normative legal basis of migration activities, the quality of which primarily depends on the effectiveness of state activities to regulate migration process. Today, the Concept of State Migration Policy of the Russian Federation for 2019–2025 years determines the improvement of legal, organizational and other mechanisms regulating and ensuring the main directions of its implementation as one of the main tasks of domestic migration policy. The article analyses the legislation regulating migration relations in modern Russia. The authors conclude that it is necessary to improve the normative legal framework for migration legal order in the Russian Federation.
