Abstract

The article analyzes definition and nature of the right to the inviolability of the creative work from the point of international acts and the national legislation of the Russian Federation. Thus, we studied the circle of subjects of the right to the inviolability of the creative work, the procedure for the protection of this right. Also the article studies the provisions of the Berne Convention for the protection of literary and artistic works, the judicial practice of the Court of Intellectual Rights of the Russian Federation. As a result of research the author makes the conclusions about the features of the Russian judicial practice in the area of study.
