Administrative responsibility for violation of the requirements of the legislation on transportation security

Abstract

The article addresses the problems associated with the establishment and application of administrative responsibility in the field of transport security on air transport. The author analyzes the qualifications of administrative offenses in this category, identifies defects of the current legislation, taking into account the materials of judicial practice and rulings of the Constitutional Court of the Russian Federation. According to the author, the rules establishing administrative responsibility for violations of mandatory AS requirements and for TS violations should be combined, providing for responsibility in a single area of ATS. In addition, it is advisable to allocate these offences in an independent chapter in the Special Part of the Russian Code of Administrative Offenses.
