Prescription about the transfer to the federal budget of income obtained from monopolistic activities or unfair competition: the legal nature and relationship with the involvement of administrative responsibility

Abstract

Investigated the theoretical and practical aspects of issuing an order to transfer to the budget income received from actions that violate the requirements of antimonopoly legislation, and bringing to administrative responsibility for unfair competition and monopolistic activities. The analysis of the legal nature of the prescription as a measure of state coercion and a measure of legal responsibility is carried out. It is concluded about the necessity of renouncement from this institution and leaving the possibility of bringing to administrative responsibility for antimonopoly violations.
