Deputy mandate under conditions majority and proportional peoples representation

Abstract

The majoritarian, proportional system and their numerous combinations and varieties are based on differentiated approaches to the formation of elected collegial and individual bodies, which is due to the existing political system in the country (multi-party, two-party or one-party), a combination of party and non-party representation, as well as the need resolving a number of legal and organizational tasks and functions (determining the conditions under which elections are recognized as valid or invalid, valid or invalid, effective or ineffective, etc.). The article provides a historical and legal analysis of the origin of democratic institutions in Russia, at different stages of its historical development. As a result of the study, the constitutional and legal nature of the deputy mandate was revealed (imperative in the context of using the majority or proportional electoral system).
