Prosecutor's supervision as an Integral Element of the Administrative-procedural Form under the Code of the Russian Federation on Administrative Offenses

Abstract

In the proposed article, the author poses the question of the administrative-procedural form of proceedings in the case of an administrative offense, its meaning and content, legal regulation. In the course of the conducted research, the conclusion is made about the unity of procedural requirements and guarantees in the framework of the implementation of the administrative procedural form of proceedings in the case of an administrative offense; the uniqueness of the procedural form of consideration of cases of administrative offenses is emphasized. The article proposes to consider the prosecutor's supervision as an integral element of the administrative-procedural form under the Code of the Russian Federation on Administrative Offenses. Prosecutor's supervision as an element of the legal structure of the "administrative procedural form" performs a special role in achieving the objectives of the legislation on administrative offenses and the objectives of the proceedings in such cases.
