Interaction of the legal principle and the legal presumption within the property of presumptiveness of constitutional principles/

Abstract

The article provides a characteristic of the property of presumptiveness of constitutional principles, within the framework of which aspects of the relationship between legal principle and legal presumption, which is a tool for monitoring the proper observance of the provisions of constitutional principles by the subjects of legal relations, are investigated. The study of the relationship between legal presumption and legal principle examines the concept of a legal presumption, its sectoral affirmation, questions of the presumptive composition of legal relations, and the positions of legal scholars on the issues under consideration.
