On the question of single connection to electric networks

Abstract

Importance: the article examines approaches to understanding the one-time connection to electrical networks, resolving the issue of the presence in the actions (inaction) of a network organization of an event of an administrative offense, liability for which is provided for in Article 9.21 of the Code of the Russian Federation on Administrative Offenses (hereinafter referred to as the Code of Administrative Offenses of the Russian Federation). Purpose: iIdentification of problematic aspects when resolving the issue of bringing a network organization to administrative liability under Article 9.21 of the Code of Administrative Offenses of the Russian Federation. Research design: study of the current regulatory framework, judicial practice in the field of the issue under study in order to develop recommendations for the application of the provisions of the Rules for the technological connection of power receiving devices of electrical energy consumers, electrical energy production facilities, as well as electrical grid facilities owned by network organizations and other persons , to electrical networks approved by Decree of the Government of the Russian Federation of December 27, 2004 No. 861 (hereinafter referred to as the Rules) and Article 9.21 of the Code of Administrative Offenses of the Russian Federation using an example from the practice of the Office of the Federal Antimonopoly Service for the Voronezh Region (hereinafter referred to as the Office). Results: recommendations for amending the federal law and Rules were reviewed and proposed. The implementation of these recommendations will streamline the procedure for technological connection of Partnerships to the electrical networks of network organizations and legislate evidence confirming the fact that members of the Partnership are connected to the electrical networks of the Partnership
