Abstract

Importance: the subject of the study is the study of key signs and methods for identifying fictitious and deliberate bankruptcy. Purpose: one of the most pressing problems is the preservation of the general level of financial stability and solvency by the subjects of the business environment. Many companies faced the problem of providing the production process with the necessary material and production resources, the rise in the cost of attracted capital, etc. In an unstable political and economic situation, the problem of insolvency or bankruptcy becomes especially urgent. A key role in assessing the presence of signs of intentional or fictitious bankruptcy belongs to the forensic accounting examination. An objective assessment, focused on ensuring the protection of creditors’ rights, helps not only to prevent abuse, but also allows you to assess the real financial situation of the debtor. Research design: despite the officially published data on the decrease in the total number of bankruptcy procedures, which in 2025 decreased to a historic minimum of 6477, it should be noted that the contribution of the debtors themselves to the initiation of the procedure increased significantly - from 9.5% to 16.5%. The increase in the number of applications for declaring bankrupt predetermines the need for a thorough and comprehensive analysis of each of the declared cases to identify signs of fictitious or deliberate bankruptcy. Results: the article made a comparative analysis of deliberate and fictitious bankruptcy, developed an algorithm for conducting a forensic accounting study to identify the facts of deliberate or fictitious bankruptcy of the organization.
