Классификация злоупотребления правом в юридическом процессе России

Аннотация
Приводится классификация злоупотребления правом в юридическом процессе с акцентом на практическую значимость приводимых критериев дифференцирования. Среди классификационных критериев рассматриваются такие, как связь с субъективным правом, отрасль права, субъектный признак, объект посягательства, последствия злоупотребления правом, качественный признак, состав лиц, характер поведения субъектов, злоупотребляющих правом, формы злоупотребления правом. Приведены практические примеры, иллюстрирующие каждую группу злоупотреблений и сделан вывод, что рассмотренные особенности явления злоупотребления правом в юридическом процессе позволят сформулировать эффективные меры противодействия ему.
