Не-ответственность монарха и ответственность президента

Аннотация

Проводится сравнительный анализ института ответственности применительно к монарху и президенту. Монарх не подлежит ни юридической, ни политической ответственности, поскольку монаршая власть имеет трансцендентный источник. Напротив, власть президента производна от народа-суверена, который является его главной инстанцией ответственности – как юридической, так и политической. Однако в реальности привлечь президента к ответственности весьма непросто. Автор показывает некоторые причины этого. Проблему президентской ответственности усугубляет сходство институтов президента и монарха. Как теория, так и конституционное законодательство нередко тяготеют к наделению президента некоторыми, по сути, монархическими свойствами.
