Право на охрану здоровья и медицинскую помощь в условиях эпидемии

Аннотация
Рассматриваются подходы к пониманию права на охрану здоровья и медицинскую помощь, а также общие тенденции последних лет в изменениях ее гарантий. Анализируется состояние права на охрану здоровья и медицинскую помощь в период противодействия пандемии COVID-19. Рассматривается вопрос легитимности вводимых в условиях противодействия эпидемии ограничений, возможные рамки таких ограничений, в том числе с учетом современных доктринальных подходов. Сделаны, в частности, выводы, что в Российской Федерации в период противодействия пандемии COVID-19 право на охрану здоровья и медицинскую помощь фактически было ограничено; необходимо совершенствовать систему РСЧС, созданную для защиты конституционных прав, в том числе права на охрану здоровья и медицинскую помощь.
