Манипулирование юридическими целями и средствами в процессе толкования права: понятие, содержание, технологии
Аннотация
Поднимается проблема манипулирования юридическими целями и средствами в правоинтерпретационном процессе – широко распространенная, но практически не исследованная в отечественной юриспруденции форма правомерного поведения. Аргументируется позиция, согласно которой манипулирование юридическими целями и средствами имманентно правовому регулированию общественных отношений в целом и толкованию права в частности. На конкретных примерах раскрываются содержание, специфика и технологии манипулирования юридическими целями и средствами в правоинтерпретационном процессе, а также его влияние на правотворчество и реализацию права.
