Служебное право в России: многозначащие новеллы законодательства о государственной службе 2020–2022 гг.
Аннотация
Рассматриваются основные новеллы законодательства о государственной службе в Российской Федерации в период 2020–2022 гг. Показаны главные институты служебного права, которые были модернизированы федеральными законами, внесшими изменения и дополнения в систему нормативного правового регулирования отношений на государственной службе. Делается вывод, что расширение понятия государственной службы под воздействием новейшей концепции публичной власти и ее конституционно-правовой реализации в системе российского служебного права обусловливает противоречивые подходы к пониманию государственной службы и усиливает правовую неопределенность в характеристике ее сущности и предназначении. Исследуются вопросы: установления нового основного принципа организации и функционирования системы государственной службы (защита системы государственной службы и профессиональной служебной деятельности государственных служащих от иностранного влияния); уточнения соотношения публично-правовых и трудовых правовых начал в регламентации государственно-служебных отношений; введения в практику экспериментов в системе государственной службы; заключения контракта с военнослужащими, достигшими предельного возраста пребывания на военной службе; введения дополнительных гарантий для государственных служащих в связи с призывом гражданских служащих на военную службу по мобилизации или заключением ими контракта о прохождении военной службы; закрепления институтов приостановления и возобновления государственной службы, а также дополнительных оснований для увольнения государственного служащего.
