Крестьянское право (вторая половина XIX – начало ХХ вв.): структура и содержание
Аннотация
Статья посвящена механизму функционирования крестьянского права, который рассматривается как совокупность норм, определяющих внутриобщинную жизнь крестьян и не сводится только к правовому обычаю. Он включает в это понятие элементы судебного правотворчества волостных судов, сельского схода, мнение стариков – знатоков «старины», общественное мнение, складывающееся вне официальных структур, но оказывающих влияние на принятие решений.
