Движение к правозащитной модели инвалидности: общий взгляд на опыт и потенциал субъектов Российской Федерации
Аннотация
Статья посвящена общим вопросам реализации полномочий органов государственной власти субъектов Российской Федерации в сфере социальной защиты инвалидов. Автором рассмотрены основные результаты анализа нормативных правовых актов регионального уровня и практики их применения. Наиболее существенные проблемы социальной защиты инвалидов в контексте правового регулирования в субъектах РФ классифицированы по содержанию на проблемы нормотворчества и проблемы реализации. К первой группе отнесены ошибки при формировании модели разграничения полномочий между РФ и субъектами РФ, влекущие бессистемность правового регулирования, терминологическая неупорядоченность и нехватку документов. Вторая проблема выражена в бюджетном и налоговом дисбалансе, провоцирующем неравномерные социально-экономические условия субъектов РФ и бюджетные возможности. При этом в статье отмечается потенциал субъектов РФ в контексте формирования правозащитной модели инвалидности, реализованный сегодня лишь отчасти и заключающийся в возможности наиболее точно выявить территориальные особенности условий жизнедеятельности инвалидов и отразить специфику в нормативных правовых актах.
