Приговор в аргументативном дискурсе уголовного судопроизводства
Аннотация
Затрагиваются вопросы обоснования судом своих выводов в приговоре. Анализируются отдельные аспекты содержания описательно-мотивировочной части приговора, ее функционально-семантические особенности. Исследуются логико-языковые приемы, с помощью которых осуществляется обоснование выводов суда как особая форма аргументации. Подчеркивается, что обращение к теории аргументации обогащает юридическое понимание обоснованности и мотивированности судебного акта. Утверждается, что приговор является структурообразующим решением во всем уголовно-процессуальномдискурсе, поэтому нeльзя рассматривать приговор вне коммуникации, предшествующей ему и следующей за ним.
