Formation and nature of electronic evidence

This article examines the nature and formation of electronic evidence, analyzes the current legislation and the main points of view of scientists regarding the allocation of an independent type of electronic evidence, the ratio of electronic evidence and virtual traces is carried out. In our opinion, a priority position is also determined on the need to form not only an independent type of electronic evidence, but also the formation of a fundamentally new concept of an electronic society with a specific methodology that corresponds to modern digital realities and meets the "challenges" of reality.
