Малозначительность деяния: оценочное понятие уголовного закона

Аннотация

Анализируются природа и сущность малозначительности деяния, выявляется соотношение понятий «малозначительность» и «общественная опасность» деяния, определяются доктринальные точки зрения относительно наличия в малозначительном деянии признаков состава преступления, рассматривается феномен малозначительности деяния с учетом положений иных отраслей права, содержащих регламентацию малозначительности, производится критический анализ предлагаемых в науке формулировок соответствующих законодательных положений о малозначительности, а также осуществляется обзор судебной практики по делам, где имела место малозначительность деяния. Исследуются различные точки зрения на понимание сущности малозначительности деяния, но даже в разных подходах можно найти общие характеристики. Необходимо, по представлению автора, закрепить существенные черты малозначительности деяния, предлагаемые доктриной, непосредственно в Уголовном кодексе РФ. Итогом исследования является формулирование признаков, на основании которых можно рекомендовать судам устанавливать малозначительность деяния.
