К вопросу о видах ограничений для публичных служащих в Российской Федерации
Аннотация
Предлагаются разнообразные критерии для разделения ограничений, установленных законодательством для публичных служащих, на различные группы. Исследование ограничений в контексте их видового разнообразия позволяет определить их свойства, закономерные связи с особенностями отдельных видов публичной службы и показывает их важное место в структуре правового статуса публичных служащих. Классификация ограничений содействует выработке системного подхода к исследованию императивных начал на публичной службе. Делается вывод о преимущественно административной (публично-правовой) природе как ограничений, так и правового статуса публичных служащих в целом, о сущностном единстве этого статуса вне зависимости от видов публичной службы.
