Российские «контрсанкции» как современная форма реторсий
Аннотация
Международные экономические санкции, став неотъемлемой частью современной политической и правовой жизни, послужили причиной формирования новой правовой реальности в России. Отвечая на вызов «недружественных» государств, в российском правопорядке сформировался целый пласт «контрсанкционных» норм. В рамках настоящей статьи автор исследует природу «контрсанкций» в контексте международного частного права, а именно сравнивая их с институтом реторсий. Автор приходит к выводу, что реторсии, как институт международного частного права, направлены на формирование баланса прав и интересов собственных граждан, юридических лиц и иностранных лиц, при этом в целях восстановления нарушенного состояния возможно отступление от соблюдения принципа соразмерности реторсий.
