Финансирование судебных процессов сторонними лицами: осмысление зарубежных моделей в условиях повышения судебных пошлин в России
Аннотация
Феномен «финансирования судебного процесса», изначально возникший и широко распространенный в странах общего права, всё больше проникает в континентальный процесс. Вместе с тем накопленный опыт функционирования данного правового института уже приводит к его переосмыслению в странах, активно его применяющих. С этой целью необходимо рассмотреть обоснованность использования данного механизма не только с точки зрения расширения доступа к правосудию, но и с точки зрения проблем и этических дилемм, присущих его применению.
