Влияние возраста на реализацию гражданами свободы труда: конституционное и антидискриминационное законодательство зарубежных стран
Аннотация
На основе анализа тестов конституций зарубежных стран, трудового и специального антидискриминационного законодательства ряда государств Европы и США, судебной практики выявлены особенности применения принципа запрещения дискриминации при реализации гражданами свободы труда и права на труд в зависимости от возраста. Сделан вывод, что отношение в законодательстве и судебной практике к возрасту как к признаку дискриминации отличается от подходов к другим дискриминационным основаниям. Реалии современного рынка труда требуют изменения подходов к политике в области защиты граждан от дискриминации по возрастному признаку как в зарубежных странах, так и в России.
