Общеизвестные факты как обстоятельства гражданского дела, не подлежащие доказыванию, в практике российских судов

Аннотация
Рассматривается вопрос о применении российскими судами ч. 1 ст. 61 Гражданского процессуального кодекса Российской Федерации и ч. 1 ст. 69 Арбитражного процессуального кодекса Российской Федерации. На основе анализа широкой судебной практики и конкретных примеров делается вывод о том, что отсутствие четких критериев общеизвестных фактов приводит к произвольному толкованию данной категории судами, что в ряде случаев может стать причиной нарушения процессуальных прав сторон и вынесения необоснованного решения.
